International Migration and International Law
This Committee will pursue a work program with the objective of developing recommendations on key issues relating to the international legal regulation of migration, and with the further objective of establishing international migration law as a recognized field of international law, bringing together both public and private international law aspects. The work program of the Committee will focus on the following three themes: 1) identification and interpretation of existing international legal norms from both public and private international law perspectives and relevant institutions; 2) collection of evidence of state practice and opinio juris for formation of customary law; 3) legal mechanisms for addressing claims of migrants. The Committee will be focusing on cross-border migration and will not deal with internal migration issues (some of these were covered by the work of the former ILA Committee on internally displaced persons). Based on the findings of its work program, the Committee shall make recommendations to the ILA membership for the adoption of resolution(s) with respect to the above-mentioned subject matter areas.
